Ending full section 75 homeless duty – because applicant has refused a private rented tenancy

A letter for ending the section 75 accommodation duty because:

  • the applicant has refused a private rented sector offer.

This is a ground for ending the s.75 duty, under section 76(3)(b) of the Housing (Wales) Act 2014.

An offer is "private rented sector offer" if:

  • it is an offer of an assured shortold tenancy
  • the tenancy has a fixed term at least six months
  • the tenancy is offered to the applicant by a private landlord
  • the accommodation is suitable for the applicant's occupation
  • the offer is made with the authority's approval, and
  • the offer is made in pursuance of arrangements made by the authority with the landlord, with a view to bringing the authority's duty under section 75 to an end (H(W)A 2014, s.76(4)).
