Non-cooperation procedure

A template that homelessness managers can use to draft a procedure to meet the statutory requirement under Part 2 of the Homelessness (Review Procedure etc) Regulations 2018 SI No 223.

Sections 193B and 193C of the Housing Act 1996 provide local housing authorities in England with a power to end the homeless prevention or relief duties if an applicant deliberately and unreasonably refuses to take a mandatory step in their housing plan.

Part 2 of the 2018 Regulations require an authority who wishes to use this sanction to have a written procedure which:

  • complies with the requirements of regulation 3,and
  • is kept under review.

There are spaces in the document for including procedural steps that are unique for your authority, for example:

  • Steps that need to be taken on your particular ICT software.
  • How correspondence with the applicant should be saved.
  • Action that must be taken in respect of a housing register application if the homelessness duty is discharged because of non-cooperation.

A provision is included that a senior officer must give approval for the s.193B(5) warning notice (unless the officer giving the notice is, him or herself, of a certain seniority). It's up to you whether you want to retain or delete this provision (since, unlike the discharge notice, there is no statutory requirement for the warning notice to be authorised by another officer).
