Section 202 homeless review decision letter - upholding end of relief duty because applicant refused suitable final offer

This letter provides a template for notifying a section 202 review decision to a homeless applicant, where the council is reviewing a decision to end the s.189B relief duty because the applicant refused a final offer of accommodation which was suitable for them.

In addition to the issue of suitability the letter also addresses the other mandatory issues which must be considered (under section 193A of the Housing Act 1996), namely:

  • Whether the offer qualified as a final offer.
  • Whether the applicant was informed of the consequences of refusing before they refused.
  • Whether they were informed of their right to request a review of the suitability of the accommodation before they refused.
  • Whether the applicant were subject to obligations in relation to their existing accommodation which they could not bring to an end, before being required to take up the offer.
